Preferences for foreign students with employment in the territory of the Republic of Belarus

Employment in the Republic of Belarus by foreign nationals who do not have permits for permanent residence in the Republic of Belarus under employment contracts with employers of the Republic of Belarus are regulated by the Law of the Republic of Belarus of December 30, 2010 “On External Labor Migration”.

Foreign citizens carry out labor activity in the Republic of Belarus subject to the availability of a special permit for the right to engage in labor activity in the Republic of Belarus and the conclusion of an employment contract.

The Law of the Republic of Belarus of January 5, 2016 “On Amendments to the Law ‘On External Labor Migration’”, which came into force on July 15, 2016, amended the list of foreign citizens not covered by the Law.

So, foreign citizens are exempted from obtaining special permits for labor activity in the Republic of Belarus:

  • who receive higher education in the educational institutions of the Republic of Belarus and are employed in the specialty they receive;
  • who received higher education in the educational institutions of the Republic of Belarus and are employed on the received specialty and assigned qualification within one year after receiving the specialty and qualification award.

This rule applies only to students who receive higher education or graduated from higher education institutions and are employed by the acquired specialty and assigned qualifications.

Thus, if a foreign citizen studying at a higher education institution desires to find a job in the Republic of Belarus for the specialty received during the education period, then the employer who employs him does not need a special permit.

If a foreign citizen who has received a higher education, is employed on the received specialty and assigned qualification within one year after receiving the specialty and qualification assignment, the employer also does not need a special permit for him. However, this rule of law does not apply to the second and subsequent years after receiving an education.

The above categories of foreign citizens acquire the right to employment on a par with citizens of the Republic of Belarus.
